General Rule: Any health care provider who suspects a child has been abused or neglected MUST report this immediately to local department of social services in the area where child resides or the abuse or neglect (allegedly) occurred. In the alternative, the health care worker may have the person in charge of the health care facility make the report of child abuse. The health care provider must document and disclose all information, which is the basis of his/her suspicion. Child protective service has a right to such records. Failure to make the required report within 72 hours of first suspicion leaves the health care worker susceptible to a civil fine.(Reference: Virginia Code §63.1-248.3)
CHILD ABUSE REPORTING PROTECTIONS
General Rule: A person who discloses suspicion of child abuse is protected from liability, unless it is shown that the person making the report acted in bad faith or with malicious intent. (Reference: Virginia Code §63.1-248.5)
